Musicademy Student Contract - Terms and Conditions

The following terms and conditions apply to all Musicademy courses.

General Information

A contract is formed between the Musicademy and you (the student) at the point when you accept the offer of a place in order to follow a course with Musicademy.

The contract is made up of these Terms and Conditions and related regulations and documents. In the event of inconsistencies with other Musicademy documents (such as the information leaflets, website or other material which describe the courses) or written or oral statements made by the Musicademy’s employees or agents, these Terms and Conditions shall prevail.

The Terms and Conditions standardise existing arrangements in an attempt to clarify the legal relationship between Musicademy and its students and they apply to all students of Musicademy. It is important that you read and understand them.

Queries about these Terms and Conditions should be addressed to the Directors at Musicademy who shall be responsible for determining any matters of interpretation.

New editions of these Terms and Conditions shall be uploaded to the website www.musicademy.com and may be publicised by other means so that you can be aware of any changes.

You are required as a condition of enrolment to accept and comply with all Musicademy regulations including these Terms and Conditions.

Enrolling on a Course

Class numbers are limited and early booking is recommended to avoid disappointment.
To enrol on a course you can:

  1. Telephone the Musicademy office on 01923 282878 quoting your credit, debit or switch card number. Please note that a 4.1% surcharge is made for credit cards – this is the amount that our Merchant Services provider charges us for the use of credit cards.
  2. Post your cheque (made payable to Musicademy Ltd) to Musicademy, Oak Tree House, Berry Lane, Chorleywood, Herts WD3 5EY. Provide your email address of enclose a stamped self-addressed envelope if you require a receipt.

Please note that course fees must be paid in full at the time of enrolment and in advance of the start of the course in order to secure a vacant place. Refunds will not normally be made to students who, having enrolled, find the course unsuitable or cannot otherwise attend, as these matters should be determined prior to enrolling. Places once secured are not transferable or refundable however, subject to the discretion of the Directors we may

sometimes be able to arrange a transfer or refund under exceptional circumstances. Please note that you have no legal right to transfers or refunds.

Musicademy does not take payments in class as it takes up valuable teaching time. Where students qualify for an early booking discount, payment must be received on or before the expiry date of the discount period.

There are no fee concessions for family members, students on benefit, children etc however students taking a vocals course in addition to another course are eligible for a £30 discount per term.

Musicademy is proud of its reputation for delivering high quality music training, having helped hundreds of people learn and refine new skills. We hope that you will find the course you select suited to your individual requirements and that you have an enjoyable and rewarding time with us

We aim to offer a wide range of courses but do not guarantee that all courses will be available to all students who are qualified to take them. We also reserve the right to withdraw a student from a course if we find that the learning is not suitable for them, or if they are not suitable in some way for the course.

Course Cancellations

Musicademy very much regrets having to cancel or transfer courses at short notice. This normally only occurs when student numbers are too small to run a class. Please help us to avoid this by enrolling well in advance of the commencement date of your chosen course.

Minimum student numbers are required for courses to run. Musicademy reserves the right to cancel or combine a course due to insufficient recruitment. Students may be offered the opportunity to transfer to a similar course which may be at a different time or day, or request a refund.

Musicademy reserves the right to provide a substitute teacher for classes other than the one advertised.

Materials and Equipment

Most of our courses require the use of specialist equipment which may incur additional costs and must be purchased by the students. These include:

  • For all guitar courses – a guitar, tuner, plectrum (and capo for mileage courses, intermediate courses and electric masterclasses).
  • For bass courses – bass guitar and preferably a bass tuner and thick plectrum.
  • For drum courses – drum sticks and a practice pad. It is also advisable to have a drum kit at home for practicing.
  • For DJ Skills courses – no decks necessary but we would advise more advanced students to have decks, a mixer and amp at home for practice
  • For keyboard courses – we provide keyboards at the venue but a piano or keyboard is required at home for practice.
  • Music Production and Vocals – no equipment necessary.
  • Backing track CDs – Musicademy has commissioned a range of backing track CDs for its vocals, guitar, bass and worship classes. These are available at £16 per CD and are a useful practice aide.
  • Students are advised not to purchase items until they have obtained confirmation that the class will be running.
  • Our website recommends a number of local and mail order suppliers or instruments and equipment.

Communication

As a small business, Musicademy is not able to guarantee that we will be able to telephone or post updates to our students. We normally email updates, requests, reminders etc to students therefore we ask that students provide us with a current email address at all times.

Individuals on our database may at any time request that their details be erased. Until that time, individuals may be emailed or contacted by Musicademy in relation to our own products and services.

Data Protection Act 1998

Musicademy is registered with the Data Protection Registrar (register entry Z854950X). The information you provide will be shared with other individuals for the purpose of administration, teaching and other guidance, and statistical and research purposes.

At no time will your personal information be passed to organisations for marketing or sales purposes. From time to time students are approached to take part in surveys by mail and phone, which are intended to help us monitor performance, improve quality and plan future provision.

Musicademy is a limited company registration no: 05084217.

Venues

Musicademy teaches at a variety of community venues which we hire from churches, schools, parish councils etc. As such we do not have complete control or authority over the venue and occasionally may experience problems with access, heating etc which are beyond our control. Should this occur we are not bound to provide recompense although, in the case or non access, we would normally try to run that session at another time as an alternative. Students would be expected to either attend or forgo the replacement session.

Musicademy shall not be liable to the other for any failure or delay in performing its obligations under this contract if such failure or delay is due to any cause beyond that party’s reasonable control, and, for the purposes of this contract, will include (but will not be linked to) governmental actions, wars, riots, civil commotion, fire, flood, epidemic, labour disputes (including labour disputes involving the workforce of any third party) and Acts of God.

Musicademy cannot accept responsibility, and expressly excludes liability, for any loss or damage suffered by a student in connection with his/her attendance at Musicademy courses including:

Personal injury or death (except where this is caused by the negligence of Musicademy); Damage to instruments

The consequences of any modification or cancellation of programmes as set out above;

Damage to your property (including vehicles and bicycles parked at hired venues)

Infection of students’ equipment caused by computer viruses and the consequences of such damage.

Students with Disabilities

Musicademy tries to ensure that disabled people, including those with learning difficulties, are treated fairly. As Musicademy does not own the buildings it teaches from, we are not able to guarantee full disabled access at all times although we will try to ensure that venues are accessible if a particular student notifies us in advance of difficulties. If you have a disability or illness that you feel may affect your ability to attend or take full advantage of the course, please contact Musicademy for an informal discussion. Some students may require a parent or carer to attend the class with them in order to maximise their learning.

Changes to our Terms and Conditions

Musicademy reserves the right to change the Terms and Conditions from time to time both before and after you enrol. Changes may be made in order to:

  • comply with any changes in the law or to take account of a ruling by a court or similar body;
  • to implement legal advice, national guidance or good practice;
  • to provide for the introduction of new or improved methods of operation, services or facilities;
  • to reflect market conditions;
  • to make them clearer or more favourable to you;
  • to rectify any error that might be discovered in due course;
  • or further to codify existing arrangements.
